The Club issued a new Disciplinary Code of conduct (including Terms of Reference) during the mid nineties, and so the following regulations are of importance to mainly committee members if matters arise, as follows….
WEST BRETTON VILLAGE CRICKET CLUB TERMS OF REFERENCE AND PROCEDURES FOR DISCIPLINARY MATTERS
1. Terms of Reference
The Disciplinary Procedures of the Club may be invoked in regard to
1.1 The Breach of any club rule or regulation
1.2 Failure to observe local or league codes of practice
1.3 Riotous or disorderly behaviour (either singly or collectively)
1.4 Wilful or negligent damage of club property or the property of others or refusal to make good any wilful or negligent damage.
2. Procedure
2.1 Every allegation of an offence regarding a breach of discipline shall first be heard by the Club’s Selection Committee or the Committee of Management. If it is decided that there is a case to be heard, the Club’s Disciplinary Committee shall be convened as identified by the Club’s Management Structure. The procedure recognises there are different degrees ranging from ‘petty’ to ’serious’ misconduct but that for a Disciplinary Committee to have been convened the alleged offence will fall into the category of ’serious’ misconduct.
2.2 The Committee Chair or Secretary will invite the Club Member to a meeting or hearing convened under this procedure.
2.3 The member may be accompanied at the hearing by a representative or friend.
2.4 It is expected that the hearing will be convened in the shortest possible time but to allow the member to arrange representation and all parties to assemble any evidence or witnesses.
2.5 Should the member choose not to attend with or without a bona fide reason the meeting or hearing may proceed at the discretion of the Club Chairman.
2.6 A full investigation into the circumstances of misconduct will be conducted by the Committee.
2.7 Witnesses may be called to attend the hearing and written statements may be submitted by any party involved.
2.8 The Chairman will explain the purposes of the hearing and consider with the committee statements from all parties.
2.9 This procedure may be varied with the agreement of all parties if a variation is deemed to be more appropriate in any particular case.
2.10 The outcome and findings of the Committee will be communicated at the earliest opportunity to the member(s) and confirmed in writing with a report made to the Club’s Committee of Management at its next meeting.
3. Sanctions
The Committee may impose one or more of the following penalties..
3.1 A Reprimand
3.2 A Severe Reprimand
3.3 An order for compensation to meet any damage to property
3.4 Exclusion from playing membership for a defined period
3.5 Exclusion from access to any Club premises or facilities for a specified time
3.6 Suspension of membership for a specified period
3.7 Expulsion from the Club
4. Appeal
4.1 There will be NO right of appeal against the outcome of this procedure.
